1.3 Booking, when a job has been arranged through using the site, leading to a contract between you and the service professional.

1.5 Service Professional, the professional that will perform the collection specified in your booking, may also be called a ‘Professional’.
1.6 Users, a customer who uses the website to arrange collections.

1.9 The Job relates to the work provided by the contractor, the collection.

The service is a booking website that connects customers with on demand waste collectors. Customers of the Kollect website are individuals seeking to obtain a professional service from these professionals, and therefore are customers to the professionals once the booking has been complete. The service is a platform purely to arrange this booking, and is not responsible for the job or actions carried out by the professional. The company does not have control over the professionals as they are not staff, and therefore cannot provide guarantees over quality, legality, failure to provide or any aspect whatsoever of professionals actions; the job is provided by the contractor. The Kollect service only provides booking abilities to allow you to set up a contract with service professionals.
The company has the right to change, update, and suspend the service without any notice, whether it is permanent or temporary. We may also update the terms and conditions if any changes are made to the service. If this situation arises the changes will be posted 14 days before changes come into effect. Please note it is your own responsibility to check these terms and conditions for updates, as you are bound by them when using the service.
Kollect recommends each of the contractors but cannot be held responsible in any way for their actions. Customers should always use caution when interacting with contractors to protect their property and safety, as you would when interacting with anybody whom you do not know. Kollect cannot be held responsible for contractors conduct, and customers hereby release the company and its affiliates from any liability related thereto. Kollect will not be liable for any claim, injury or damage arising in connections with your use of the service to arrange a booking.
Your Feedback may be published as testimonials on our website using your First Name and Location. If accept by filters (Validations, language etc.) then your comment will be publically viewable. Kollect is not responsible for misuse of your content by viewers. Kollect encourages you to post honest and civilised feedback as it may be read by others. Kollect is not responsible or does not endorse any other customer’s feedback, this is to be read at your own discretion.
Customer must keep a valid debit/credit card on the site. Customers are required to keep their information updated, and change their details if their situation changes.
Customers are charged the full amount upon booking; we do not pay the contractor until the job has been completed to ensure a sufficient level of standard is maintained. If you believe the job is not complete then you have 48 hours from when you receive your feedback email to report any issues. If customers do not respond then we assume there are no problems with the job.
Prices include VAT, unless users are told or informed otherwise.
Cancelations, you can cancel a booking 24 hours in advance contacting us through the website or emailing support@Kollect.com . You will be unable to cancel the booking under 24 hours in advance as this is too late notice to contact and cancel the professional. Charges will still be applied, and we reserve the right not to make a refund on this transaction. In the event of a refund, from cancellation of service in the appropriate time frame, any money due to you will be paid within 30 days. If a service provider does not show, you have 48 hours to send a complaint email to explain the situation, where a re appointment can be arranged or else a full refund /extra credit, will be applied to your account. If however the professional did not show because the address you supplied is incorrect then, charges will still be applied and no refund will be issued.
The company reserves the right to cancel any booking without notice, for any reason, which will be explained via email. If this situation arises then the company will refund any money in the escrow account that is due to you. The company many also suspend your access to the site with no warning but an explanation will be provided via email. If this situation arises, re-registering is not permitted. The company does not hold any card information, as we use third party vendors, therefore you agree to void Kollect of all liability in the event of a security hacking for details concerning your payment information. Kollect uses Stripe to process payments, which is 100% PCI Compliant, and handles all financial card details. Any reimbursements due to Kollect may be paid via the online web service or in cash.
Kollect may issue customers with discount codes, which can be redeemed when using the service.
Kollect also may issue referral codes to customers or contractors, that lead to credit being applied to one or both parties accounts.
All promotions are run at Kollect’s discretion. These vouchers may only be distributed to your personal friends and acquaintances, and may not be sold, advertised, or any attempt made to gain credits outside legitimate referrals. Breach of this condition is determined at Kollect’s discretion. Kollect may apply a reasonable administration fee to your account including payment of the amount due by you from your incorrect use of credits. Kollect may also terminate or suspend your account.
You as a customer are also responsible for holding up the following conditions. Putting your bin in a visible place at the supplied address. You must give us 24 hours notice if you wish to cancel, otherwise you will still be charged for; payment to the contractor, and/or administration fees. You must report your feedback within 48 hours, failure to voice any problems before this point will mean the job cannot be mediated fairly and your satisfaction guarantee will be voided. You will be able to leave feedback anytime, but we will not be able mediate on this information.
Any complaints can be made through support@Kollect.com unless otherwise stated in this document (see section 4).
Location of arbitration is Republic of Ireland. All terms and conditions shall fall under Irish Law and any disputes will be decided under Irish Law and any courts will be held in the Republic of Ireland.
This agreement cannot and does not void anything, which may be excluded illegally.
Nor does this agreement void our liability for negligence causing death or person injury or for misrepresentation of a fraudulent nature.
The company will not be liable for any damage caused by us or by our contractors where the circumstance was unforeseen by both parties,
or no breach of care has occurred. The company employees are also voided from liability where employees are within their rights of legal duty of care,
which is owed to you from us.
Under no circumstances will the company be liable for economic losses, loss of reputation, loss of data (Inc. breaches), even where negligence occurs.
The company disclaims any liability that may arise between users of its service.
Your hereby indemnify, defend, and hold harmless the company, and all of its staff and all its affiliates from any and all claim, loss, expense or demand of liability, in connection with your use or inability to use the service.
No independent contractor, agency, partnership, joint venture, employer-employee or franchiser-franchisee relationship is intended or created by this Agreement.
All content (graphics, data, formatting, designs, text, typefaces) that users see is owned by the company, or used by permission. Content is protected by copyright, and users may not copy, redistribute, sell (including renting or licensing) or redesign any of the company’s content unless the company has specifically granted permission. Content may only be downloaded for caching purposes.
The company does not employ its service professionals and can therefore in no way be held responsible for any tax withholdings, or withholding of any other information that should be declared. If the company is found to be liable for any tax withholdings based on your use of the service then you will reimburse the company the equivalent amount immediately including the payment of interest, fees or penalties that may apply.
Failure of enforcement of the provisions set out in this document by Kollect will not be construed as a waiver of any provision or right. If any provision is considered to be unenforceable or invalid for any reason, it will be replaced with a provision of similar consequence, and the remaining provisions will be enforced as intended. If a provision cannot be enforced nor modified the remaining provisions are still enforceable to their full force and effect.
