1. Definitions; terms and their meanings
1.1 The Site, refers to the website “Kollect.ie”1.2 The Service, the use of the site to make a booking, the booking or monthly/yearly packages and pay as you go packages and is not related to the collection made by the contractor.1.3 Booking, when a job has been arranged through using the site, leading to a contract between you and the kollect1.4 Contractor, the professional that will perform the collection specified in your booking.11.6 Users, a customer who uses the website to arrange collections. Anyone that books through Kollect is a customer of Kollect.ie and not the contractor that collects on behalf of Kollect.ie1.7 The Company, relates to the business name Kollect on demand Ltd1.8 Kollect.ie relates to the business name under the corporate body Kollect On Demand Ltd or Kollect Development group1.9 The Job relates to the work provided by the contractor, the collection.

3. The Service
The service is a booking website engine that connects customers with waste contractors for on demand waste collection, and for monthly or yearly contracts. Customers of the Kollect website are individuals seeking to obtain a waste collection service by a third party but remain at all times a customer of Kollect.ie (Kollect on demand Ltd). The service is a platform purely to arrange this booking, and is not responsible for the job or actions carried out by the professional. All Collections are contracted out to licensed waste collectors. Your personal data will be passed onto whatever 3rd party contractor that will fulfil your waste collection job, including but not limited to: phone number, address and name.
4. Provision of Service
4.1 The Agreement is personal to the Customer. The Customer shall not, except with Kollect’s written consent or in accordance with Kollect’s standard transfer procedures, assign or otherwise transfer this agreement in whole or in part.4.2 In no event shall Kollect be liable to the Customer for damage suffered by the customer as a consequence of acts or omissions of third parties, service professionals or contractors.4.3 Fair Usage Policy applies: Kollect reserve the right to suspend the services to the customer wholly or partially if the Bin(s) are an excessive weight (i.e. where the Customer is disposing in excess of their weight allowance of waste in the general waste Bin) or the contents of the Bin(s) exceed the capacity of the container (i.e. a Bin is regarded as overloaded when the lid of the Bin does not sit comfortably on the body of the Bin). Please note that an average general bin weighs 30kg. If your bin continually weights over this we will charge the customer 18 cent extra a kilo for bins that are over 30 KG. Don't worry we will inform you if this issue arises and try and help you to reduce your next collection weight. As of 30th September and in line with new legislation kollect charge customers a set collection fee with restrictions on weight. Any customer who goes over our agreed waste band for general/ municipal waste is charged an extra per kilo price. This will encourage our customers to use the compost and recycling bins.4.4 The customer shall keep the Bins safe and secure. In the event that the Bin(s) or any part thereof are lost or stolen, the Customer shall immediately notify Kollect and shall remain liable for the cost of replacing any Bin or part thereof. A charge of €30 per Bin will apply.4.5 Permit the Waste Company and any other person authorised by them at all reasonable times to enter upon the premises in which the receptacle is for the time being placed or kept for the purpose of inspection, collection and examining the condition of the receptacle or repairing the same or taking possession thereof.4.6 By using the Kollect service you are acknowledging that you own your own bins or are using bins that have been provided to you by Kollect on demand and will, under no circumstances, present a bin that does not belong to you, for collection. Legally, we cannot and do not pick up bins belonging to a third party.4.7 Customers must abide by segregation lists as set on mywaste.ieRecycling items as set out on: https://www.mywaste.ie/wp-content/uploads/2019/02/RecyclinCampaign_A2_420x594_FA.pdfFood waste items as set out on: https://www.mywaste.ie/wp-content/uploads/2018/11/caddy-sticker-print-version.pdf No Hazardous, bulky or ashes may be placed in the general waste bin.
Kollect recommends each of the contractor's, service professionals and third party bodies but cannot be held responsible in any way for their actions. Customers should always use caution when interacting with contractors to protect their property and safety, as you would when interacting with anybody whom you do not know. Kollect cannot be held responsible for contractors conduct, and customers hereby release the company and its affiliates from any liability related thereto. Kollect will not be liable for any claim, injury or damage arising in connections with your use of the service to arrange a booking. All our contractors are independent operators with their own insurance policies.
6. Booking engine
Kollect only facilitates the online booking of bin collection/Junk collection or skip hire. We do not pick up waste/ junk or provide skips. We therefore can accept no liability for any part of the physical bin collection/Junk collection or delivery/collection of the skip. Kollect is a booking engine to arrange a contract between you and the third party, service professional, or contractor.
Your Feedback may be published as testimonials on our website using your First Name and Location. If accepted by filters (Validations, language etc.) then your comment will be publically viewable. Kollect is not responsible for misuse of your content by viewers. Kollect encourages you to post honest and civilised feedback as it may be read by others. Kollect is not responsible or does not endorse any other customer’s feedback, this is to be read at your own discretion.
8. Billing and Payment
For Pay As You Go Customers:Customer must keep a valid debit/credit card on the site. There is an annual service fee of €25-€80 depending on package, payable at the start of a new account set up and on the 12th month anniversary of the account creation for each year of service. So if you join Kollect in June 2016 you must pay your annual fee in June 2017. Just to reiterate your initial membership or sign up fee is a annual charge.For All Fixed Collections:8.1 Customers must pay in advance for collections, and then every four weeks. Kollect reserve the right to issue bills in a paperless format. Unfortunately Kollect will impose a penalty charge of €8 on unpaid direct debit instalments or credit card payments. This is for the admin involved in missed payments and processing them.Terms and conditions of our Two month Free offer: In order to avail of this offer you pay two months in advance. To activate the first free month, you simply need to let us know in advance which month you want free. If you are good enough to stay with us for the second year, you can activate your account by letting us know in the office when you want your second free month..ie month 13 or whichever month thereafter.Annual customers may have up to 4 flexi collections a year depending on offer valid on time of sign up. One collections can be redeemed every three months. This can be either of the three bins types example one general bin collection. To redeem this offer you need to contact our customer support team to organise your collection. Flexi collections cannot be used as a cash alternative or all 4 in one period.
9. Your responsibilities
You as a customer are also responsible for holding up the following conditions. Putting your bin in a visible place at the supplied address. Any disputes must be made with 24 hours of scheduled pick up.
Customer service is our priority and we will always do our best by our customers. We are very fair and appreciate our customers so much and will do our utmost to retain customers. Any complaints can be made through firstname.lastname@example.org, facebook or by phone. We will resolve straight away.
12. No Agency
No independent contractor, agency, partnership, joint venture, employer-employee or franchiser-franchisee relationship is intended or created by this Agreement.
13. IP Rights
All content (graphics, data, formatting, designs, text, typefaces) that users see is owned by the company, or used by permission. Content is protected by copyright, and users may not copy, redistribute, sell (including renting or licensing) or redesign any of the company’s content unless the company has specifically granted permission. Content may only be downloaded for caching
14. Contractors Withholdings
The company does not employ its service professionals and can therefore in no way be held responsible for any tax withholdings, or withholding of any other information that should be declared. If the company is found to be liable for any tax withholdings based on your use of the service then you will reimburse the company the equivalent amount immediately including the payment of interest, fees or penalties that may apply.
15. General Provisions
Failure of enforcement of the provisions set out in this document by Kollect will not be construed as a waiver of any provision or right. If any provision is considered to be unenforceable or invalid for any reason, it will be replaced with a provision of similar consequence, and the remaining provisions will be enforced as intended. If a provision cannot be enforced nor modified the remaining provisions are still enforceable to their full force and effect
